Terms of Use

These terms are between you and Sundermarch, an independent game project ("we", "us"), and cover the Sundermarch website at https://sundermarch.gg and Sundermarch accounts. By using the site or creating an account, you agree to them. Questions: contact@sundermarch.gg.

1. The game is in development

Sundermarch is being built. The website, the game and everything shown (names, classes, artwork, features, dates) may change, be delayed or be removed. Nothing here is a promise of what the finished game will contain or when it will arrive.

2. Your account

• You must be 16 or older. Testing the game needs an account and requires you to be 18 or older (see the Tester Terms).
• One account per person. Give us a real email address you control; we use it to confirm your account and for account emails only.
• Keep your password to yourself. You're responsible for what happens under your account unless we've caused it. Tell us at contact@sundermarch.gg if you think someone else has access.
• You can delete your account at any time from your account page. That deletes your account and everything attached to it (see the Privacy Policy, section 6).

3. Your information

How we collect, use and protect your information is explained in the Privacy Policy, which is part of these terms. In short: we collect very little, store it in Sydney, Australia, use only essential cookies, and never sell it.

4. What you agree not to do

• Don't break into, overload, scrape, or interfere with the site, other people's accounts, or our systems.
• Don't try to bypass security, including the staff area, rate limits or age checks.
• Don't share, sell or hand over your account.
• Don't use the site to harass, threaten or abuse anyone, or to post anything unlawful.
• Don't pretend to be us, our staff, or anyone else.

If you find a security problem, please tell us privately at contact@sundermarch.gg instead of using or sharing it. We'll treat good-faith reports kindly.

5. Suspending or closing accounts

We may suspend or close an account if these terms, the Tester Terms or our community standards are broken, if the account is used to harm the site or other people, or if the law requires it. We'll tell you why unless we can't. You can ask us to reconsider at contact@sundermarch.gg.

We may also close the website or accounts entirely if the project ends. If so, we'll give reasonable notice where we can, and delete personal information as described in the Privacy Policy.

6. Our content

Sundermarch, its name, logo, artwork, world, characters, lore, text, and the website's design and code belong to Sundermarch, an independent game project (or our licensors). You may look at and use the site personally. You may not copy, sell or redistribute our content, except that fair dealing / fair use (such as reviews, commentary and news) and any sharing we explicitly allow (for example for public tests) are fine.

7. Feedback

If you send us ideas, suggestions or feedback, you agree we can use them freely to develop Sundermarch without owing you anything. We won't credit or pay you for feedback unless we agree otherwise in writing.

8. Things we can't promise

The site and accounts are provided "as is". We work hard to keep them running and secure, but we can't promise they'll always be available, error-free or fit for any particular purpose. To the extent the law allows, we're not liable for loss or damage arising from using the site, except where caused by our own negligence or breach, and nothing here removes rights you have under the Australian Consumer Law or other laws that can't be excluded.

9. Changes to these terms

We may update these terms. We'll post the new version here with a new date, and for important changes we'll tell you by email or on your account page before they take effect. If you keep using the site after that, the new terms apply.

10. Law and disputes

These terms are governed by Australian law, and disputes go to the Australian courts, except that if you're a consumer in the EU or UK you keep the protection of your local consumer law and courts.
